Dissolution and Legal Separation
Dissolution terminates the parties’ marital status, whereas a legal separation maintains the parties’ marital status. Dissolutions and legal separations both involve issues of child custody and visitation, child support, spousal support, and property division that need to be resolved. We have successfully handled matters ranging from simple property divisions to disputes involving multimillion-dollar assets. We have expertise negotiating and litigating disputes involving real property (business and residential), small businesses, retirements/pensions, and stock and financial accounts.
We have extensive experience in establishing parental relationships when the parties were not married, including obtaining orders for child custody, visitation, and support.
Child Custody and Visitation
Custody and visitation of minor children are very important issues in a family law case. We understand client concerns and will work to establish or modify a custody and timeshare arrangement that is in the best interests of the minor children, either through agreement with the other parent and his or her attorney, or through litigation.
Child and Spousal Support
Child support is determined through use of a computer program implementing a statutory formula, which takes into account the income and timeshare of each parent. In contrast, the amount and duration of spousal support is determined through an evaluation of many factors subject to the broad discretion of the court. We bring substantial knowledge and skill to the negotiation and litigation of support issues to give our clients the best possible outcome.
We listen to our clients’ needs and provide options tailored to achieve each client’s goals. We can provide full representation in all aspects of a client’s case or limit our involvement to certain discrete tasks, such as an appearance at one hearing or preparation of documents. The clients decide what tasks they feel they are able to handle on their own and what tasks they want Gonsalves & Kozachenko to handle. Limited scope or unbundled family law service is an affordable alternative to traditional representation and allows parties that previously had no or limited access to legal services with much needed legal advice and assistance to navigate the complex laws and rules associated with family law matters.
